The due date to file your Income Tax Return (ITR) for the Assessment Year 2024-25 (FY 2023-24) is 31st July 2024, unless extended by the tax department.

It’s important to submit your income tax returns (ITR) on time. Missing deadlines can lead to late fees, penalties, and unnecessary complications.

Penalty for Late Filing

Under updated rules in Section 234F of the Income Tax Act, late filing ITR late can result in a maximum penalty of Rs. 5,000.

Starting from the financial year 2021, the maximum penalty for late filing has been reduced to Rs. 5,000 from Rs. 10,000.

For FY 2023-24, if you file your ITR by July 31, 2024 (September 30, 2024 for audits and October 31, 2024 for transfer pricing cases), no penalty will be imposed.

After 31st July 2024, the penalty limit increases to Rs. 5,000. However, the Income Tax department offers relief to small taxpayers, with a maximum penalty of Rs. 1,000 if your total income does not exceed Rs. 5 lakh.

Revised Time for Correction

If you make a mistake in your ITR, you have until 31st December of the assessment year to correct it. Previously, this window was two years from the end of the financial year, but it’s now reduced to nine months.

Interest on Unpaid Tax

If you miss the income tax filing deadline, you will have to pay 1% interest per month on any unpaid taxes (Section 234A). Additionally, taxes must be paid before filing your ITR.

Penalties start accruing from the day after the due date, which is typically July 31 of the assessment year. Therefore, delaying payment means you will end up paying more.

Refund Delays

If you are eligible for a tax refund from the government for overpaid taxes, you must file your return by the deadline to speed up the refund process.

Losses Carry Forward

Belated ITR Filing can prevent you from carrying forward certain losses to offset against future income. Losses under capital gains or business must be filed within the due date for carry-forward eligibility, except for losses from house property.

It’s important to file your ITR on time to avoid penalties, interest charges, loss of refund opportunities, and the inability to carry forward losses. Early filing not only minimizes financial implications but also provides more time for corrections if needed.
